Local 4041 2020 Convention Call

The Executive Board of AFSCME Local 4041 is pleased to announce our biennial CONVENTION is hereby called to convene at the Grand Sierra Resort in Reno, Nevada, July 7, 2020, at the hour of 9:00 a.m. and will remain in session until such time as it has given full consideration to such matters as legallymay be brought before it.

REGISTRATION SCHEDULE 

Monday, July 6 3:30 p.m. to 6:30 p.m. 

Tuesday, July 7 7 a.m. to 9 a.m.* 

*VOTINGTo be eligible to vote in the election of officers on Wednesday, July 8, delegates must be registered by 9 a.m. on Tuesday, July 7.

AMERICANS WITH DISABILITIES ACT 

AFSCME Local 4041 will make every effort to assist in ensuring the accommodations and convention space at the Grand Sierra Resort are in compliance with the Americans with Disabilities Act. If a delegate anticipates a special need ensuing from a disability, the delegate should contact Sonja Whitten at sonja@nvafscme.org by Friday, June 5. AFSCME Local 4041 will attempt to accommodate special needs to ensure that delegates can participate fully in convention activities. Early notice is necessary because some accommodations may require significant advance preparation. 

REPRESENTATION The biennial AFSCME Local 4041 convention is the most important policymaking body of our Local. The vitality and democracy of our union depend upon participation in the convention by delegates from all Chapters in good standing. Important resolutions, constitution and bylaws amendments, and the election of the AFSCME Local 4041 President, Vice President, Recording Secretary, Secretary-Treasurer, (8) Regional Vice Presidents, (8) Alternate Regional Vice Presidents, and one Trustee per region, will be in the hands of the delegates. Each Chapter should take part in the election and in all other important convention business. Plan now to ensure representation from your Chapter. 

Please review the following information carefully. The constitutional provisions set forth in Article V of AFSCME Local 4041 Constitution approved on April 10, 2019 by International President Lee Saunders have been adopted to ensure members are represented in their governing body. Delegates must be nominated and elected according to: 

Article V, Section 12. All delegates and alternates to the convention of the local shall be elected in accordance with the provisions of Appendix D, Elections Code, of the International Constitution. The names of such delegates shall be certified by the appropriate officers of the chapters to the Secretary Treasurer of the local at least ten (10) days prior to the time of the convention. 

***Elections for delegates and Chapter Officers were conducted prior to our originally scheduled Convention dates of April 20 -22, 2020. *** 

Please note that throughout this Convention Call, the term “member” refers to a qualified member who is in good standing, and the terms “AFSCME Local 4041 constitution” refer to the 2019 AFSCME Local 4041 Constitution; and “AFSCME Local 4041 bylaws” refer to the Bylaws adopted January 2018. 

HOW TO DETERMINE NUMBER OF DELEGATES. 

Article V, Section 6, of the AFSCME Local 4041 constitution provides Chapter Representation shall be entitled to delegates based on membership as follows: 

Representation in the Local Convention is accorded to each Chapter, on the basis of one (l) delegate for each fifty (50) members, or major fraction thereof The Chapter membership shall be computed on the basis of the official membership list maintained by the Administrative Office as of January 1st of each year. Active Chapters shall be entitled to at least one (1) delegate regardless of membership. 

Chapters may elect one (I) alternate delegate for every delegate. 

Article V, Section 13. Cost sharing: Costs for the annual convention will be shared between the Administrative Office, the chapters and the delegates. The local shall pay for the meeting rooms, binder contents, awards, banquet, luncheons and travel based on current policy. Delegates, alternate delegates and/or chapters are responsible for their lodging and any meals not provided. alternate delegates and/or chapters are responsible for alternate delegate travel costs. 

Article V, Section 14. Delegates shall serve a one-year term or until their successors are duly elected. Nominations and elections of delegates to the local convention shall take place each year not more than 120 days prior to the opening of the convention. 

Article V, Section 15. Each chartered retiree chapter or sub-chapter in Nevada, in good standing with AFSCME international, shall be entitled to one delegate and one vote. Such delegate shall be entitled to all the rights and privileges of the delegates except that such delegate shall not be entitled to nominate any candidate for Local 4041 office as a chapter or sub-chapter delegate or to cast the chapter's or subchapter's vote in the election of Local officers unless such delegate has been elected to that position by secret ballot vote conducted among the members of the chapter or sub-chapter affiliated with such delegates retiree chapter or sub-chapter. The provisions of this section do not apply to amalgamated chapters or amalgamated sub-chapters chartered by AFSCME International. 

YOUR DELEGATION CANNOT BE SEATED UNLESS: 

1.The credential list of all elected delegates and alternates is in the Local 4041 officeno later than June 5, 2020, as spelled out in the section herein titled“CREDENTIALS.”

2.All other good-standing requirements are met no later than June 26, 2020, asspelled out in the section herein titled “GOOD STANDING.”

Any challenge or appeals will be referred to AFSCME International Union general counsel, who will make recommendations with strict constitutional interpretation to the AFSCME IU executive council. 

GOOD STANDING 

Article IV, Section 4. Membership dues shall be payable monthly in advance to the local secretary-treasurer and in any event shall be paid not later than the 15th day of the month in which they become due. Any member who fails to pay dues by the 15th day of the month in which they become due shall be considered delinquent, and upon failure to pay dues for two successive months shall lose their good standing status and stand suspended. Provided, however, that any person who is paying dues through a system of regular payroll deduction, bank draft, or similar system, shall for so long as such person continues to pay through such deduction method, be considered in good standing. 

Article IV, Section 5. A member suspended under the above section may be reinstated to membership in the local on payment of all arrearages plus the current month’s dues. 

CREDENTIALS All active chapters will be sent a credential packet containing detailed instructions for reporting elected delegates and alternates to the convention. Chapters/delegates are strongly encouraged to use/complete the online registration forms, which is convenient, secure and environmentally responsible. Online reporting must be completed no later than June 4, 2020. 

CONSTITUTION AND BYLAWS AMENDMENTS AFSCME Local 4041 chapters may submit proposed amendments to the AFSCME Local 4041 constitution and bylaws to the convention as provided in Article X of the AFSCME Local 4041 constitution. and Chapter VI of the AFSCME Local 4041 bylaws. 

All proposed amendments should include both the current wording and the proposed change. The proposed amendment should be signed by the President of the Executive Board or Chapter President submitting the amendment, certifying that it has been approved for submission to the convention by the Executive board or membership of the chapter. Properly signed proposed amendments may be emailed in PDF format or faxed to Autumn Zemke and must reach the national office by May 22, 2020. Send proposed amendments: Autumn@nvafscme.org 

RESOLUTIONS 

For 2020, all proposed resolutions shall be in accordance with Chapter VI of AFSCME Local 4041 Bylaws.

CONVENTION COMMITTEES 

Delegates assigned to a convention committee should attend the meeting of that committee. A delegate may request to testify on resolutions, especially those submitted by a delegate’s chapter, that have been assigned to other convention committees. In order to ensure completion of work, however, only assigned members of a committee may debate and vote on resolutions before that committee.
